OFFICIAL RULES
No Purchase Necessary. A purchase will not increase your chances of winning. Sweepstakes is open to all U.S. Citizens who are legal residents of the continental United States and are at least 21 years of age at the time of entry. Residents of Puerto Rico, Alaska, Hawaii, Virgin Islands, Guam and other US territories are not eligible. All federal, state, and local laws and regulations apply. Void where prohibited or restricted.
1. Eligibility: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, Mary Lee Malcolm, and/or her agents. Odds of the winning prize depend on the number of eligible entries received. A winner will be selected by a random drawing from the number of eligible entries received on or about April 7, 2011. By entering, you agree to these official rules and the decisions of the Sponsor, which are final and binding in all respects.
2. Email and Privacy: Email addresses and other information received via contest entries will not be used for any purposes other than to communicate with entrants about the work of M.L. Malcolm. You may subsequently opt-out of the receipt of such email or communications by following the directions in the first such email you receive.
3. Sweepstakes Period: Sweepstakes begins Monday, March 7, 2011 at 12:00:01 a.m. (PST) and ends April 4th, 2011 at 11:59:59 p.m. (PST).
4. Entry: You may enter by any one of the following methods:
(i) Send an email to mlmalc50@gmail.com containing or attaching proof of a prepublication or pre-release purchase of the novel, “Heart of Deception,” by M.L. Malcolm (the “Book”), to be released by Harper Collins Publishers on April 5th, 2011. Receipts scanned and attached to the entry email must be in jpeg or PDF format.
(ii) Forwarding an email to mlmalc50@gmail.com that contains confirmation of a purchase of the Book from an online bookseller such as Vroman’s Powell’s, Amazon or Amazon Marketplace will constitute a valid entry, so long as the existence of the bookseller as on on-going business can be easily verified.
(iii) Mail a proof of purchase of the Book along with the entrant’s name, full mailing address, email address and telephone number to: Writer’s Retreat, c/o J.G. Malcolm, 400 15th Street South #1507 Arlington, VA 22202. Mail-in entries must be received by the close of the Sweepstakes.
(iv) Free Method of Entry: Mail a single sheet of paper with the words, “Heart of Deception Writer’s Retreat Sweepstakes,” along with the entrant’s name, full mailing address, email address and telephone number to: Writer’s Retreat, c/o J.G. Malcolm, 400 15th Street South #1507 Arlington, VA 22202. Mail-in entries must be received by the close of the Sweepstakes.
Limit: One (1) entry per person for the duration of the Sweepstakes Period. Incomplete, unreadable, or unintelligible entries shall be disqualified. Entries will not be acknowledged or returned. Neither entries nor prizes are transferable. In the event of a dispute as to the identity of a winner where an entry was made electronically, the winner shall be deemed to be the person whose name appears on the exact credit card that was used to pay for the book, or, in case of cash purchases, the name of the person in whose name the e-mail account governing the e-mail address was opened.
5. Prize/Odds: The winner will receive a one-week, Saturday-to-Saturday stay at Laurel Edge, a private home owned by John and Mary Lee Malcolm, located in Scaly Mountain, North Carolina. During the week’s stay the winner will have excusive use of Laurel Edge for him or herself and may invite up five (5) additional guests. No more than six (6) people total may stay in the home with the winner, and this total includes any minors accompanying adult guests. Guests are strongly discouraged from bringing children who are under four (4) years of age. To schedule his or her stay, the winner must consult Sponsor at least two weeks in advance of the date of their proposed stay; the stay must take place during a mutually agreeable week between April 30, 2011 and May 1, 2012. The stay may not include the week of Labor Day or Thanksgiving Day. The prize consists of the use of Laurel Edge for private, non-commercial purposes only, and winner must provide Sponsor with the names and contact information of all guests at least forty-eight (48) hours prior to the beginning of the stay.
Laurel Edge is fully furnished, and the stay includes full use of all linens and cooking utensils provided; however, provision of all food, paper products and any other expenses are the sole responsibility of the winner. Laurel Edge is within a two hour and thirty minute drive from Hartsfield-Jackson International Airport in Atlanta GA, and within an hour and thirty minute drive from the Asheville Regional Airport in Asheville, NC, under normal traffic conditions. No transportation will be provided. No smoking is allowed inside the home. No pets over thirty (30) pounds may accompany the winner or his or her guests unless individually pre-approved by Sponsor.
The prize value is $1500. Liability for any applicable taxes will be the sole responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. The odds of winning depend upon the number of eligible entries received. No cash substitutions, transfers or assignments by prize winners will be permitted. The approximate retail value of the prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the approximate retail value is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. If the actual value of a prize is less than the stated approximate retail value, the difference will not be awarded.
7. General Conditions: Winner must complete, execute and return an Affidavit of Eligibility, a Liability Release, and where lawful, Publicity Release within fourteen (14) days of notification. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, disqualification will result and an alternate winner will be selected. By accepting prize, where permitted by law, winner grants to Sponsor (and agrees to confirm that grant in writing) the right to use and publish his/her name and picture for advertising, trade and promotional purposes without additional consideration without notification, review or approval. Further, by accepting the prize the winner agrees to discharge, indemnify, release and hold harmless John and Mary Lee Malcolm, Harper Collins Publishers, Book Reporter.com, their respective parents, affiliates, subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Sweepstakes related activity, or participation in this Sweepstakes. All winners are subject to additional prize terms and conditions, documentation and requirements that may not be stated herein.
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or web site; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
8. Limitations of Liability: Sponsor is not responsible for any incorrect, inaccurate, lost, late, misdirected, incomplete, illegible or mutilated entries or entry information. Sponsor is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes. Entrants shall be solely responsible for all Internet access and usage charges imposed by an entrant’s online service provider. If, for any reason, the Sweepstakes is not capable of running as planned by reason, for example but not limited to, of infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the winner from entries received prior to the action taken, or as otherwise deemed fair and appropriate by Sponsor. IN NO EVENT WILL SPONSOR, HARPER COLLINS PUBLISHERS, THE BOOK REPORT, INC, JOHN MALCOLM, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTERING THE CONTEST OR USE OF THE PRIZE. 9. Arbitration/Choice of Law: Except where prohibited, entrants agree that (1): any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without regard for conflicts of law doctrine.
10. Severability; Headings: If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official rules or any provision hereof.
11. Winner List: Prize winner shall be notified by telephone, email and/or overnight mail whichever is appropriate on or after April 7th, 2011. Selected winner shall be required to respond (as directed) to the notification within seven (7) days of attempted notification date. The failure to respond timely to the notification shall result in forfeiture of the prize and, in such case, Sponsor will randomly select an alternate winner from among the remaining eligible entries. Prize winners shall be required to verify name and address and to execute before a notary public and return within seven (14) days of receipt an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media issues, unless prohibited by law. Prize shall not be awarded until all such properly executed and notarized forms are returned. The name of the winner can be obtained my sending an email request to mlmalc50@gmail.com.
